    Default Homemade silencer legal?

    I know it is illegal to fabricate a fully automatic firearm, but what are the legalities of fabricating your own silencer? Do you need to have an FFL to do it, or can you apply for a tax stamp and build one?

    You need to file a form 1, pay $200 tax.

    MGs are the only NFA item that was banned from civillian ownership or manufacture. With an approved Form 1 you can build any other NFA item you want.

    Like far too many you do not indicate your state of residence. Some communist states do not allow silencers. The Form 1 requires the same stuff as a Form 4, namely a CLEO signature, picture, fingerprints, one time $200 tax.

    Of course, if your CLEO is clueless and won't sign you can form a corporation and file your forms anyway. It avoids need for Pics, signature and FP cards. Any officers of the corp can then possess the item, say your wife or adult children. If the corp is sold, the NFA items go with it but do not need a tax paid transfer to do so as long as the corp name is retained.

    DO NOT build the item or any part of it prior to getting the approved form 1 back!!!!!! Be sure to keep copies of the approved form 1 in a safe place OTHER than with the NFA item!!!!!!!!

    Sorry for my ignorance but I am looking at the Form 1 right now... Would I just make up a serial number for the silencer that doesn't exist yet then?

    Yes; Check state laws. Can't get NFA stamp in Missouri without first holding FFL.

    Also, if you make any mistake on form & it's denied.........Don't
    expect your $200.00 back any time soon.

    Oh yeah.... don't make "spare parts" to have around. Parts are considered silencers in and of themselves. Stupid, yes, but that's the way they interpret it.
