    Default lagal questions

    hey a quick question that probably wont have a quick answer i am under the understanding that for a semi auto rifle to be legal it has to have a 16 inch barrel and a minimum length of 26 inches now is this with the stock extended or folded? and is there anything that i am missing??? thanx in advance

    State and local laws apply to and over-rule fed. guidelines. Michigan comes to mind. Others can post the .gov links I lost from my last favorites links, your overall guidelines are correct to the best of my knowledge.

    Michigan measures folded. Under 26", SBR. 26- 30", pistol. Pistol needs purchase permit, saftey inspection and certificate to posess. [No underfolder folders for me with removeable muzzle device ] Do have plans to weld on a Hotbarrel brake to get one to "legal" length.

    Federal requirement is measured with stock extended. As others have indicated, state laws vary.

    The overall length should be with the stock folded.

    This has been hashed out numerous times on numerous boards. ATF letters posted confirmed the stock in the open position for measuring.

    I keep hearing this, but have never seen a link to the ATF letter. Can anyone provide it?

    A Yugo under folder is only 25" folded so if the law was 26" folded it would be ilegal with out a welded barrel extention. I would like to see the atf letter as well

    CFR Part 179 Sub-Part B - Definitions

    179.11

    ...."The overall length of a weapon made from a shotgun or rifle is the distance between the extreme ends of the weapon measured along a line parallel to the center line of the bore."

    the stock is part of the weapon.......extend the stock, extreme both end, and it over the legal length...........now some states or local comunities may measure them with the stock folded......but this is what the federal law says about OAL.
