The U.S. Court of Appeals for the 8th Circuit, based in Missouri, rejected an appeal brought by Joaquin Bravo Flores, who was charged with possessing a firearm. Agreeing with the 5th Circuit, the court concluded that the protections of the Second Amendment do not extend to undocumented immigrants.
I guess I do not agree with this ruling. I do not think illegal immigrants should be here, but the laws of the land should apply to everyone here. That would be like asying they have no right to any guarantees of the bill of rights. If this is the case, you can just arrest them and hold them indefinetlly without any charges.
This kind of BS really makes my head hurt. We been watching way too much TV, and worrying about a new car for the last 50 years to see the mire of crap we have made for ourselves, we have wound our own noose. It's been an enjoyable/relatively peaceful half a century.

I've always been of the understanding that "the people" were bona fide citizens and not just any person residing in the U.S. While it might seem patently unfair, basic legal rights of illegal aliens ARE being held to constitutional scrutiny while other rights (such as gun ownership) are not.

Since an illegal immigrant is actively committing a crime by just being on American soil, I can see why you would prohibit him from being armed. If ya didn't, the guy robbing the Quik Mart could argue he has a right to bear arms during his robbery and thus extra time for using a gun would be UnConstitutional....

When I lived up near Traverse City, there was a ot of shooting between Indian & white fishermen. Natives were gill netting & deer huting year around & the poor white guys had to follow white mans law. Rifles have talked for a long time in Mich.. Heh...Heh

now that the troops are coming home from iraq, we can keep the pilots working a bit longer and fill the military transport planes up with illegal immigrants and ship them back all of them including their anchor babies, heck even our socialistic european allies do this evey year

There was a paper written by, I think the Law foundation, or some other Constitunal study group like that a few years ago, I can't remember just whom it was. But anyways the leagel findings was that the Constitution Does Not grant constitutional rights to non citizens, same as with enemy combatents. While I do not disagree with any of you regarding the legal rights and status of Illegals, I do feel that I need to point out some things that I understand from my reading of our Constitution.
1. The Founders said "all men" Not Citizens.
2. The Founders said "inalienable rights", with no exceptions.
3. The only concept of citizenship was related to the participation in elections, and the political process of America which was established by the Constitution.
4. The Bill of Rights was (IN MY OPINION) established to guarantee these basic rights in a status beyond all law, and beyond the reach of politics to all men.
So, at least in my view; the illegals do have some certain rights under the Constitution. They have the right to representation. They have the right to not incriminate. They have the right to worship as they please. I can enumerate more, but I think I am preaching to the choir.
What these illegals do not have a right to is residency. They do not have the right to own property. They do not have the right to enter into contracts. They do not have the right to benefits. Their children have just about every right that our own children do, subject to the legal status of their parents. Read that last one carefully. NO 14th amendment rights for anchor babies if the parents are not legal.
So, my post starts out reading kinda lib-tard. I agree, but I really do believe that the Founding Fathers meant all men, everywhere. This is why I bristle when I hear America being defined as an Imperial Power in the Lib-Tard journals that pass as history books in our schools. We, as Americans want EVERYBODY to have the same advantages that we have, and the same rights, and the same benefits, as endowed by our creator.
But! Please notice before you light up the flame-throwers that I state the clearly obvious in my following paragraph.
All of the poor, tired, hungry, suffering masses need to stand up and kick some ass to get what God has given them. We need to shine the way, and train the smart ones for a generation or two to lead the rest. Look at Japan. Look at Taiwan. Look at Germany. Hell, even Vietnam got the message, and they won in the end.
