New Mexico: Court expands police power to take guns from cars
Police can remove a gun from a car during a traffic stop to ensure their safety even when they have no specific suspicion that the occupants are dangerous and pose a threat, the state Supreme Court concluded.
Contained in the courts answer , "minimal intrusion does not outweigh safety" is in it's self a recognition that the ruling is in violation of constitutional rights in the name of safety.
