Ohio General Assembly Passes Major Civil Justice Reforms; ALEC Model Legislation Well Represented, Reform Measures Provide Ohio Citizens with Comprehensive Protections, says ALEC

WASHINGTON, Dec. 14 /U.S. Newswire/ -- Today, the American Legislative Exchange Council (ALEC) hailed the members of the Ohio legislature for enacting meaningful civil justice reform in the 125th legislative session. The reform initiatives passed included: asbestos reform, construction defect litigation reform, and in the final hours of session the Ohio legislators passed a version of ALEC's Jury Patriotism Act, and a comprehensive civil justice reform bill.

"The Ohio legislature should be proud of the work they have done this session, particularly on legal reform issues," said Kristin Armshaw, ALEC's Civil Justice Task Force Director. "The legislators have taken a big step toward providing their constituents with a fair and just legal system, and a system that will help create a competitive atmosphere for businesses and encourage economic growth."

The Ohio legislature passed six civil justice reform bills based on ALEC Model Legislation in the 2003-2004 session.

-- The Notice and Opportunity to Repair Act, which creates a system for the resolution of construction defect claims that protects the homeowner while curbing unnecessary litigation.

-- The Jury Patriotism Act which reforms the jury system to ensure that every person's right to a jury of their peers is protected and that no one segment of society bears a disproportionate burden of jury service.

-- The Full and Fair Noneconomic Damages Act, which provides clear legal guideposts for the determination of damage awards and enhances the opportunity for judicial review of jury awards. Ohio is the first state to introduce and enact this specific ALEC language.

-- The Commonsense Consumption Act, which protects the food industry from frivolous obesity-related lawsuits.

-- The Successor Asbestos-Related Liability Fairness Act, which limits the liability of companies that have never produced asbestos-containing products, but have inherited the liability of other companies that they have acquired.

Rep. Bill Seitz, ALEC Civil Justice Task Force member and a lead negotiator on the comprehensive civil justice reform bill said, "I am delighted that Ohio has advanced so much of the ALEC civil justice reform agenda in one session. Over the past three years, Ohio has enacted nearly all of the model legislation developed by ALEC's Civil Justice Task Force."

"ALEC had a very good year in Ohio. A number of ALEC ideas and model bills became the law of our state and a number of others helped shape the public policy debate. This shows the quality of work that ALEC task forces are doing," said Rep. Steve Buehrer, ALEC state chair.

My guy is Tom Brinkman. He is so conservative that we would not vote for CCW because he thought it had too many restrictions on gun owners.

He is a real maverick.

Sounds like Jay Wolfe. He ran against our beloved Rockefeller last time and lost. I was at a rally for Wolfe and a lady asked him what he would do for stricter gun control. Mr Wolfe never cracked a smile and said "I would recommend sand bags or a good pair of shooting gloves."
