The Obama administration on Friday urged the Supreme Court to review and set aside an Arizona law that sanctions employers who hire illegal immigrants, saying it would disrupt the "careful balance" that Congress struck in federal immigration law.
The act in question is not the strict new Arizona law that President Obama and other members of his administration have criticized. That measure authorizes police to question the immigration status anyone who appears to be in the country illegally.
The law being challenged, the Legal Arizona Workers Act, imposes tougher sanctions than federal law for hiring illegal workers. If the court chooses to hear the case, its ruling could show how receptive the justices would be to arguments that enforcing immigration laws is a federal responsibility that cannot be usurped by the states.
The Arizona act is being challenged by a coalition of organizations that include the U.S. Chamber of Commerce, Hispanic groups and civil libertarians. Business groups want to head off a proliferation of conflicting state laws on employer sanctions, while others worry that the penalties would discourage companies from hiring even those legally in the country.
The administration, in a brief submitted by Acting Solicitor General Neal Katyal, said federal law should preempt state efforts.
The Arizona law would "disrupt a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country," Katyal wrote.
The court asked the government in November for its view of the case. The response might have been delayed by two factors. Homeland Security Secretary Janet Napolitano is the state's former governor and was the first defendant when the challenge was filed. And Obama selected Solicitor General Elena Kagan this month as his choice to replace retiring Justice John Paul Stevens.

Separately, Justice Department officials met Friday in Phoenix with Arizona Attorney General Terry Goddard and aides to Gov. Jan Brewer (R) to express strong reservations about the new law, which goes into effect July 29. The administration fears the law could lead to widespread racial profiling.
The case the court is considering is Chamber of Commerce v. Candelaria.

Screw that, send all those border jumpers back home where they belong! If they want to come here legally then let them come, I don't have a problem with that. But I am tired of hearing Spanish, reading Spanish, and watching Spanish television on my TV. This is Amerika after all.

Ya know, a couple years I would have agreed w/ 'let em come legally', but anymore I'm realizing that they are just troublemakers. Let them stay in their shitholes. Our country has enough 'diversity' already.
They want to come to the land of milk and honey, and help destroy it.
Close our borders NOW.Learn english or go home.
If they came, assimilated our culture and language, and worked to blend in by working hard, that would be one thing. But they don't. They insist on dragging us into their 'home country' culture - a culture of corruption, oppression, trampled rights, drugs, crime, gangs, bribery of cops and gov't officials as a normal way of doing business. No gun rights, bad property rights, limited free speech. In short, it's a freedom shithole. And they want to change OUR country to match the conditions that caused them to have no jobs, no homes, no hope - which is why they had to leave in the first place!

And this isn't just the border-jumpers. Look at what happens when libs flee the ratholes they've created (LA, San Fran, New Yuck City) and move elsewhere. Pretty soon, they're proposing the same misguided liberal crap that turned their original homes into festering sewers in the first place.

Migrants are a cancer. Whether illegal border-jumpers or libs fleeing a hellhole like NYC or LA or San Fran, they spread their malignant liberal disease wherever they go.

Time for some cultural chemo...

Legal or not, we don't need anymore immigrants.
Please correct me if I am wrong but is the Arizona law enforcing the law of the U S .

No wonder the President wants them here.
You've described the city of Chicago.
The real problem starts here with our citizens. Conservatives need to turn out in force and vote out the liberal mind set. We need to vote in true conservatives who don't waste money and piss off the voters. Candidates who don't have a history of helping special interests for their personal gain. It will be difficult, but everyone needs to start paying attention to whats going on and talk to their friends and acquaintances and educate them even if they don't want to hear it. The complacent attitude and ignorance in this country are the problem and we're getting close to the point of no return. When people tell me I'm to negative, I always tell them "At least I keep myself informed and won't feel guilty as the country goes down the toilet." The movie - Idiocracy , describes this country more and more every day.

hmmmmm THE STATE LAW IS PREEMPTING FEDERAL LAW AND oBAMA WANTS THAT CHANGED. SO STATES LIKE CALIFORNIA AND NEW YORK ECT THAT HAVE STRONGER GUN LAWS SHOULD NOT BE ABLE TO DO THAT EITHER????????????

THEY HAVE A RIGHT TO PROTEST MARCH ETC. LET THEM HAVE THERE FUN IN THE SUN iM SURE THERE ARE ILLEALS WHO WILL BE HAPPY TO STEAL THERE JOBS WHEN THERE OUT THERE MARCHING. OH WAIT THERE LIBERALS MOST OF THEM DONT WORK.
Why doesnt the State cops and ICE seal off the streets and nab every one of those mexicans and their collobarators. ID check-deport.
Deportation is fine, but until they seal the borders - we will still have a revolving door for the deported illegals. They go back to Mexico on Monday and are back here again on Wednesday.... Backing from the federal government is unfortunately the only answer. We need to get busy and vote out the libs in November 2010 or face the consequences.

That is exactly what has happening here in MT...All the Libtards from CA, NY, MA, CT, etc. have been moving here for the last 15-20 years to escape the shitholes that they have contributed to ruining through their idea of the 'political process'...Now they are trying out that process here in towns like Bozeman and Missoula where they have become the slight majority...And ruining these towns, in the process. It's odd, as they come here to MT for the better 'Quality of Life', as they put it and have now turned this towns into places that are really not very nice places to live anymore. The recession has helped get rid of a lot of them, but they have definitely left their mark here.

We did have illegal mexicans here; they were taking A LOT of construction jobs away from the locals during the building boom/ bubble; but most of them have left as there is no work that mexicans can do here now, as most of the agriculture ended so subdivisions could be built...

Also, as things got tighter, white folks who needed work started calling immigration on the illegals to the point that it was either leave or get busted for being an illegal immigrant. Up around Great Falls where they need them to move irrigation pipe there are still a lot I hear; but down here around Bozeman and Big Sky they have all moved on.

Yes, that's why OBumphuck doesn't like it.
As far as some of here are concerned, when the govt. refuses to do it's job, we get to take back the authority we gave them in the first place.
