Here's a question for you legal types. I was looking at some AK parts kits on k-var.com and almost all of them said that it was illegal under 922(r) to use the barrels in the kits to build into a rifle. If I purchase one of these kits, do I need to get a different barrel? And if so, from where?

ps. I'm in my final year of law school, so I looked up 922(r) on my own. It then sent me to 925(d)(3), which in turn sent me to 5845(a) of the Internal Revenue Code....

I believe you will find that this is only for manufactors not a home builder. I know I have seen more detailed info before but I cant find it now. also something about you being a thire party , but again I do not rember. someone else will I am shure.

IIRC the one in question is 5845.

Basically the hook is is that machine gun receivers and (now under a Klinton good bye ruling) barrels are not importable.

The new rules state that an importer can only import parts sets which include barrels IF they are for replacement on an already existing weapon.

The importer signs an avidavit swearing that the parts are being imported for replacement use only. The implimentation of the regulation ONLY effects importers. They CANNOT import parts kits for use in making new weapons.

When they sell you a parts kit it is with the intent that you are buying it for replacement parts.

You are under NO legal constraints to use the parts kit for replacement parts only.

If the importer sells you a parts kit that he imported with the intention that it will be used to make a new weapon , he has violated the regulation and is subject to penalties including fines , possible jail time , and lose of his import permit , merchandise and importers license.

Convulted, YES !

Illegal for you to make a new weapon from the parts kit NO !

Good comments from Triangle 66 .... let me add some practical reinforcement....

Check your barrel to make sure the serial number indicates it's date of mfg :)

OK - I'm being a Dick :) Very quickly, you will learn that there is no such thing. Once again, our brilliant Government crafted a completely unenforceable law.... and, for reference? Carbon dating has a +- 10,000 year accuracy. You are not an importer - build away.

The importer can not make a deal with a builder to build the kits they import.

Have you notcied that global trades has not offered any polish underfolders completed.
Did you notice that they can't build any polish kits.

My plan is to purchase my receivers 2 for 1. So for every 1 I need, I will purchase 2.
I will build the one I need and then keep the one I don't. My thoughts is that should another ban come up, I will still be able to get kits and build a "PREBAN" rifle since my receiver is made prior.
