Students Sue Over Removal of American Flag T-shirts

Three California high school students are fighting for their right to show their American patriotism -- even on a Mexican holiday -- after they were forced to remove their American flag T-shirts on Cinco de Mayo.
The three were among a group of teenage boys who were told by a school administrator that they had to remove their patriotic [COLOR=blue ! important][FONT=arial,sans-serif][COLOR=blue ! important][FONT=arial,sans-serif]clothing[/FONT][/FONT][/COLOR][/COLOR] or leave the school because other students were celebrating the May 5 Mexican holiday, raising fears of fighting.
The school district later reversed the administrator's decision, but on Wednesday, the three students and their parents filed a lawsuit against the Morgan Hill Unified School District and the principal and assistant principal.
The students’ attorney, William J. Becker Jr., said state law explicitly grants students the right to exercise freedom of speech by wearing “buttons, badges, and other insignia” and prohibits public schools from interfering with their speech rights unless a “clear and present danger” exists, such as the commission of unlawful acts on school premises, the violation of school rules or substantial disruption of the school’s orderly [COLOR=blue ! important][FONT=arial,sans-serif][COLOR=blue ! important][FONT=arial,sans-serif]operation[/FONT][/FONT][/COLOR][/COLOR].
"The U.S. Supreme Court has held for decades that students do not shed their First Amendment rights at the schoolhouse gates,” said Becker. "Students who wish to show their pride for another nation’s heritage should not have their speech protected more than those who celebrate America’s."


Superintendent Wesley Smith would not comment on the lawsuit, saying the district has not received official notification.
In May, Smith called the incident "extremely unfortunate" and said the school administrator had apologized.
"The Morgan Hill Unified School District does not prohibit nor do we discourage wearing patriotic clothing," Smith said in a statement issued in response to the uproar and national media attention that followed. "While campus safety is our primary concern and administrators made decisions yesterday in an attempt to ensure campus safety, students should not, and will not, be disciplined for wearing [COLOR=blue ! important][FONT=arial,sans-serif][COLOR=blue ! important][FONT=arial,sans-serif]patriotic[/FONT][/FONT][/COLOR][/COLOR] clothing."
The teens were sitting at a table outside Live Oak High School when the assistant principal asked two of them to remove their American flag bandannas. The boys complied, but then were escorted the principal's office, where they were told they must turn their T-shirts inside-out or be sent [COLOR=blue ! important][FONT=arial,sans-serif][COLOR=blue ! important][FONT=arial,sans-serif]home[/FONT][/FONT][/COLOR][/COLOR]. The assistant principal told the students he did not want any fights to break out between Mexican-American students celebrating their heritage and those wearing American flags.

I read a book called "Company C", about an Oklahoma National Guard armor unit sent to Iraq in 1991. They were staged out of Saudi Arabia.

They'd been there several weeks waiting for the big advance, when maintenance crews showed up and started painting out the small American flags on the turrets. Someone up the command chain had decided they were "offensive" to the Saudis, and so had to be covered.

The tankers were angry, and a few found some small flags at the BX and tied them to the aerials despite the orders.

Damned straight...
Last I checked they were in the United States- if they want to wear our colors that is their right! If the illeagles don't like it here's a novel thought-go home and don't come back!! We don't want or need you!! Waving that flag of theirs really pisses me off!! They said they were "disrespected"- damn straight- I don't respect anything about them!!
If they were to go with school uniforms like Japan none of this shit would matter. I think its great what they were doing but it sounds like this school system is out of control. Therefore the school's fears about fights are completely realistic since that's what happens when the inmates run the asylum. I say go with school uniforms and don't let any of the buggers get out of line. They are there to get an education, not make inflammatory political statements and show their patriotism. This isn't a football game!
Another 10 years the meskins will outnumber everyone else in California and it won't matter. The state is a lost cause - might as well give it back to Mexico and let it be their problem.

If we give it back it would be as a barren used up shithole- wait it's almost there already with Pelosi-Boxer and the rest of the vermin running things!
That school rule has so many holes in it that even if the kids win, they loose. The administration can tell the kids to take it all off because they are afraid of a fight and the way the rule is written, the kids will have to.
hmmm If I sent my kid to school witha american flag t shirt on he was told to remove it because it was a mexican holiday Id be ready to jump on the make em pay and make an example out of them. Honestly how dare they even think it was OK. afraid of a fight?? what about rival schools all wearing there school colors to a foot ball game. Im sory but chosing to make a non USA holiday more important is BS.

To many politcaly correct cranola munching pro every thing that is gay and green teachers and administraters are forming or youths minds. I dont care if they had to send home every mexican in the school first so one student can safely wear his USA shirt then thats what you do. it rediculas that you know have to give up yourrigts to allow those that dont have rights to do what they want.

its obvious they were making a politcal statement and they should there scholls and state are being swallowed by ileagles .
I think those are the same breed than those in Belgium who give us "some kind advices" about not displaying belgian flags in some parts of Brussels on July 21st.

Sounds like a deal ONLY if they're forced to keep all the liberals living there as well. Actually, that sounds like a great deal.

Interesting, the ACLU has not filed suit in favor of the students? How interesting... or not.
